Having seen in the Bolton News the article regarding the win by Mr Keiller, Mr Stephen Knapp refused to go against a High court ruling and found against Bolton council insofar as Bolton Councils Penalty Charge notices are non compliant as prior to August 23rd 2006 they only had one date on the PCN, this was also ruled in the High Court Case of Barnet v Moses when Judge Jackson said It seems to me that Section 66 (3) of the 1991 Road Traffic Act requires a PCN to have two dates, A date of Issue or Notice and a date of Contravention. Bolton's PCN's were missing the date of Contravention. I therefore ask you now to issue restitution of the Penalty Charge I paid on xx/xx/xxx to the sum of £xx.xx the PCN No is BO xxxxxx and was issued on xx/xx/xxxx for veh reg No xxx xxx I also wish to apply statutory Interest of 8% from the date I paid which is the amount the courts will allow, Sum Paid £xx.xx plus £xx.xx interest @8% Total = £xx.xx You have 14 days from receipt of this letter/email to pay restitution, Failure to pay within this time will result in a complaint to the Local Government Ombudsman by which time the costs will increase. This letter/email will suffice for my complaint and unless you do not wish that Bolton Council ends up at the Bottom of the worst Council list compiled by the LGO I would act immediately.
