Day 2 Picture 2 of Bolton's Illegal Parking Bays

Dear Mr Harriss,
As promised please find attached pictures of an another illegal Hybrid bay.
I copy here again the remarks from Department for Transport relating to this type of Bay.
Traffic signs on any road to which the public has access, including private roads, must conform to the Traffic Signs Regulations and General Directions 2002 or be specially authorised.

Mr Kelly states this picture is road marking to diagram 1028.4 but I observe a double termination marking in the photographs which does not conform to the diagram 1028.4 in Traffic Signs Regulations and General Directions 2002 (TSRGD). The road marking parking bay with a double termination in TSRGD 2002 is diagram 1032, where individual parking spaces are marked. I do not see any individual parking spaces. This marking seems to be an unlawful hybrid of 1028.4 and 1032 and does not conform to a single diagram in TSRGD 2002.

In direction 25 of TSRGD 2002 in the table (page 430) items 13,14 and 15 indicate the signs that must be used with 1028.4 which can be signs to diagram 639.1B, 660, 660.3, 660.5, 660.6, 660.7, 661.1, 661.2A, 661.3a, 662, 667, 667.1, 668, 668.1 or 801. However please also note Sub paragraph (2) on page 431 of regulations What ever is placed should also accord with the Traffic Regulation Order which places the waiting restriction.

Under the FOIA please supply the following information. I hold yourself responsible for the replies within the FOIA timeframe.

How many Penalty Charge Notices have been issued on this bay in Mawdsley St Bolton.
How many went to bailiff stage.
Please supply copy of Traffic Regulation Order for this bay
Please supply copy of Special Authorisation for this this hybrid bay.

You may treat 3 and 4 above as a normal request within Bolton Councils 10 day reply remit.

To reduce the impact on the environment and public funded postal charges, all replies should be sent via electronic means i.e. Email. No Paper copies.

If you had a PCN before August 23rd 2006 you can now get you money back automatically now follow the steps below and change it to suit your details.

Having seen in the Bolton News the article regarding the win by Mr Keiller, Mr Stephen Knapp refused to go against a High court ruling and found against Bolton council insofar as Bolton Councils Penalty Charge notices are non compliant as prior to August 23rd 2006 they only had one date on the PCN, this was also ruled in the High Court Case of Barnet v Moses when Judge Jackson said It seems to me that Section 66 (3) of the 1991 Road Traffic Act requires a PCN to have two dates, A date of Issue or Notice and a date of Contravention.
Bolton's PCN's were missing the date of Contravention. I therefore ask you now to issue restitution of the Penalty Charge I paid on xx/xx/xxx to the sum of £xx.xx the PCN No is BO xxxxxx and was issued on xx/xx/xxxx for veh reg No xxx xxx I also wish to apply statutory Interest of 8% from the date I paid which is the amount the courts will allow, Sum Paid £xx.xx plus £xx.xx interest @8% Total = £xx.xx
You have 14 days from receipt of this letter/email to pay restitution, Failure to pay within this time will result in a complaint to the Local Government Ombudsman by which time the costs will increase. This letter/email will suffice for my complaint and unless you do not wish that Bolton Council ends up at the Bottom of the worst Council list compiled by the LGO I would act immediately.
